However, we cannot accept statements that present inaccurate facts about our business or suggest that we deliberately misled you. As the business owner, I am happy to consider fair compensation for a disappointing experience, but it should not be based on allegations or assumptions about our intentions. Our product information clearly explains that wildlife sightings are never guaranteed. It does not matter whether it is sunny, cloudy, raining, or snowing — bears are wild animals, not actors waiting for the weather to improve before making an appearance. Unfortunately, we cannot control either the bears or the weather. What is particularly surprising is your claim that you were told rain “does not make a difference” and your interpretation that this somehow means we guaranteed a sighting. Those are two very different things. A change in the likelihood of spotting wildlife under particular conditions does not invalidate the fact that sightings cannot be guaranteed. You also describe the guide as having “tried his absolute best,” which we appreciate. That is precisely what our guides do. They cannot manufacture a bear simply because a customer has booked a tour. As for your comparison with seeing nine bears, including five cubs, from the Transfăgărășan a few days later — we are genuinely happy you had that experience. But seeing bears from the roadside on another day is not the same product as joining a dedicated, guided wildlife-watching experience in the forest. Comparing the two as though they are interchangeable is rather like comparing a safari with seeing an elephant from a highway. Finally, you say you are a “reasonable person” and that you understand sightings are not guaranteed. We would therefore expect the same reasonable approach when describing our communication and our product. We are happy to accept criticism when it is fair and factual, but we will not accept accusations that we deliberately misled you when that is not what happened. We are sorry you did not see a bear. We regret that outcome, but we will not apologize for something we did not do.

Since they are completely wild animals living in their natural habitat, sightings can never be guaranteed, as explained before the experience and clearly stated on the booking page. That's exactly why we offered a partial refund as an exception, or, whenever possible, another opportunity to join the experience on a different day.
